VersaTints Terms of Service

1. Overview

Welcome to VersaTints. These Terms of Service (“Terms,” “Agreement”) govern your use of our website, products, and services (collectively, the “Services”). By accessing VersaTints.com or purchasing any product, you agree to comply with these Terms as well as the Refund & Return Policy, Shipping & Processing Policy, and Privacy Policy, all of which are incorporated by reference.

If you do not agree to these Terms, please discontinue use of our website and Services immediately.

2. Eligibility

To place an order or use our Services, you must be at least 18 years old (or the age of majority in your jurisdiction). By placing an order, you represent that the information you provide is truthful and accurate, and that you have legal authority to use the payment method submitted.

3. Orders, Payments & Custom Fabrication

3.1 Payment Requirements

All prices are listed in U.S. Dollars unless otherwise stated. Payment is due at the time of purchase. VersaTints accepts major credit cards and other payment methods made available at checkout.

3.2 Custom Fabrication

VersaTints products are custom fabricated to order based solely on the vehicle information provided by the customer at checkout. VersaTints does not verify or modify customer-submitted specifications.

3.3 No Changes Once Fabrication Begins

Because each tint set is produced specifically for a single vehicle, orders cannot be modified after fabrication has begun.

3.4 Cancellations

Cancellations are governed by our Refund & Return Policy:

Orders canceled before fabrication begins → full refund
Orders canceled after fabrication but before shipment → refunded minus the 25% Fabrication Cost Recovery Fee; shipping refunded
Orders canceled after shipment → subject to the 30-Day Return Policy (unused items only)
VIP Expedited Fabrication fees are non-refundable once fabrication begins

3.5 Refusal of Orders

VersaTints reserves the right to refuse, cancel, or limit any order suspected of fraud, misuse, or unauthorized activity.

4. Shipping, Delivery & Risk of Loss

All shipping timelines, carrier expectations, and responsibilities are detailed in our Shipping & Processing Policy. By completing checkout, the customer acknowledges and agrees to that policy.

Key points include:

Shipping speed refers to carrier transit time, not fabrication time
VersaTints is not responsible for carrier delays
Customers are responsible for entering accurate shipping addresses
Responsibility for the package transfers to the customer once the carrier marks it “Delivered”
Lost, stolen, or misdelivered packages caused by incorrect addresses are the customer’s responsibility

VIP Expedited Fabrication accelerates fabrication only and does not guarantee delivery speed.

5. Returns, Refunds & Fit Guarantee

All returns, refunds, replacements, and Fit Guarantee claims are governed solely by the Refund & Return Policy, which the customer agrees to at checkout.

In summary:

Custom products cannot be resold and have limited return options
Unused items (protective film intact, no test-fitting, no installation) may be returned within 30 days subject to the 25% Fabrication Cost Recovery Fee
Used or attempted-installation tint sets are not eligible for return
Verified fabrication errors are covered by the Standard Fit Guarantee, allowing for a no-cost remake or refund
Shipping refunds are limited to specific circumstances described in the Refund Policy

The Refund & Return Policy is incorporated into these Terms as though written in full.

6. Product Use & Installation

Customers are responsible for:

Reviewing and following all installation instructions
Ensuring the vehicle matches the specifications submitted at checkout
Inspecting the tint before installation
Using only approved cleaning materials on windows before installation

Improper installation, modification of the product, or removal of protective film before confirming fit may void eligibility for certain remedies under the Refund & Return Policy.

VersaTints is not responsible for:

Damage to vehicle surfaces caused by installation
Damage resulting from the use of prohibited cleaners
Misuse or misapplication of the tint
Installation performed by third parties

7. VIP Expedited Fabrication Service

If selected, VIP service accelerates the production of your order. It does not guarantee same-day shipping or faster carrier delivery, as external factors such as weather and carrier limitations may apply.

Once fabrication begins, the VIP fee becomes non-refundable.

8. Intellectual Property

All content on VersaTints.com—including product images, text, graphics, logos, videos, and trademarks—is the property of VersaTints or its licensors. You may not reproduce, modify, distribute, or create derivative works without written permission.

9. User Conduct

You agree not to:

Use the website for unlawful purposes
Interfere with the operation of our Services
Attempt to access systems or data without authorization
Upload or transmit harmful code

Violations may result in termination of access and may expose you to legal liability.

10. Limitation of Liability

To the fullest extent permitted by law, VersaTints and its owners, affiliates, and employees shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Vehicle damage resulting from installation or misuse
Delays or failures caused by carriers

In no event shall VersaTints’ total liability exceed the amount paid for the product giving rise to the claim.

Some jurisdictions do not allow limitation of liability; in such cases, liability is limited to the minimum extent permitted by law.

11. Warranty Disclaimer

VersaTints provides products as described and makes no guarantees beyond those explicitly stated in the Refund & Return Policy and Fit Guarantee. No oral advice or informal communication shall be construed as a modification of these Terms.

VersaTints does not warrant that the website will be error-free or that access will be uninterrupted.

12. Privacy

Our Privacy Policy explains how we collect, use, and protect customer information. By using our Services, you consent to that policy.

13. Chargeback & Dispute Policy

Before filing a chargeback, the customer must contact VersaTints at support@versatints.com and allow up to two (2) business days for a response. Filing a chargeback without giving VersaTints an opportunity to resolve the issue violates these Terms and the Refund & Return Policy.

If a chargeback is filed prematurely:

VersaTints will dispute it
The customer may forfeit eligibility for refunds, replacements, or compensation
A bank decision in VersaTints’ favor is final

This policy helps ensure fair resolution for both parties.

14. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflicts of law. Any dispute shall be resolved through binding arbitration or small claims court in Sheridan County, Wyoming, unless prohibited by applicable law.

15. Changes to These Terms

VersaTints may update these Terms at any time. Changes will be published on this page and apply to future orders immediately upon posting. Continued use of the website constitutes acceptance of the updated Terms.

17. Entire Agreement

These Terms, together with the Refund & Return Policy, Shipping & Processing Policy, and Privacy Policy, constitute the entire agreement between you and VersaTints and supersede all prior understandings or agreements.
